Terms of Use
These Terms of Use (“Terms”) govern your access to and use of NoirTube, operated by Unmutedco LLC (“NoirTube,” “we,” “us,” or “our”), available at noirtube.com and through related services (the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old, or the minimum age required in your country, to use the Service. If you use the Service on behalf of an organization, you represent that you are authorized to bind it to these Terms.
2. Your Account
You are responsible for the activity on your account and for keeping your credentials secure. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.
3. Your Content
You retain ownership of the videos, images, comments, and other content you submit (“Your Content”). By submitting Your Content, you grant NoirTube a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt for technical delivery, publish, and display Your Content for the purpose of operating and promoting the Service. This license ends when you delete Your Content, except where it has been shared with others who have not deleted it, or where retention is required by law.
You represent that you own or have the rights to Your Content and that it does not infringe the rights of others or violate any law.
4. Acceptable Use
You agree not to:
- Upload or share content that is unlawful, infringing, hateful, harassing, sexually exploitative of minors, or that incites violence;
- Impersonate others or misrepresent your affiliation;
- Distribute malware, attempt to breach security, or disrupt the Service;
- Scrape, harvest, or collect data from the Service without authorization;
- Use the Service to infringe intellectual property or privacy rights.
We may remove content or restrict accounts that violate these Terms.
5. NoirTube Pro Subscriptions
NoirTube Pro is a paid subscription that unlocks additional features. Subscriptions are billed in advance on a recurring basis through our payment provider (Stripe) and renew automatically until cancelled. You may cancel at any time through your account; cancellation takes effect at the end of the current billing period. Fees, billing intervals, and features are described at the point of purchase. Refunds, where applicable, are governed by our Refund Policy.
6. Intellectual Property
The Service, including its software, design, and trademarks, is owned by Unmutedco LLC or its licensors and is protected by law. These Terms do not grant you rights to our branding except as needed to use the Service.
7. Copyright and DMCA
We respect intellectual property rights. If you believe content on the Service infringes your copyright, send a notice with the information required under the Digital Millennium Copyright Act to our designated agent through our support and compliance portal at help.noirtube.com. We may remove infringing content and terminate repeat infringers.
8. Third-Party Services
The Service integrates third-party services, including cloud hosting (Amazon Web Services), payments (Stripe), and authentication (Google, Facebook). Your use of those services is subject to their terms, and we are not responsible for them.
9. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, secure, or error-free.
10. Limitation of Liability
To the fullest extent permitted by law, Unmutedco LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim.
11. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service. Sections that by their nature should survive termination will survive.
12. Governing Law
These Terms are governed by the laws of the State of New York, without regard to conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in New York County, New York, unless applicable law requires otherwise.
13. Changes to These Terms
We may update these Terms from time to time. We will post the updated version with a new effective date and, where appropriate, provide additional notice. Continued use after changes take effect constitutes acceptance.
